  • What should you do if you are arrested?

    Generally you should not answer questions until you have had an opportunity to contact a Lawyer so they may be present whilst questioning takes place. You have a right to silence. It is important that you only offer the Police the general details they would require when processing you, such as your name, address and date of birth. Do not ever sign a document other than a bail form. Always be polite, remain calm and ask that you be afforded an opportunity to contact a Lawyer as soon as possible.

  • How long do I need to be separated from my spouse before I can file an application or divorce?

    The Family Law Act requires that you be separated for not less than twelve months before you can file an application for divorce. You do not have to live in separate homes to prove that you've been separated for 12 months. It's enough for you to live separate lives under the same roof and whilst this can be stressful, sometimes its the only option. You should however first contact us for advice on how to go about it. After all, getting it wrong is likely to complicate your divorce.

  • Who is liable to pay Child Support?

    Each of the parents of the child is liable to pay Child Support. Parents must be residents in Australia in order to be liable to pay Child Support in accordance with any administrative assessment by the Child Support Agency. There are special provisions in relation to parents who live overseas. It is not compulsory to have an administrative assessment done by the Child Support Agency and parents can enter into their own arrangements in relation to Child Support.

  • Should I make a Will?

    Anyone over the age of 18 years should make a Will. If you do not make a Will, your assets will be distributed in accordance with a method set by law which means that you assets are likely to be distributed in a way that you did not intend. Your beneficiaries may need to require access to your assets as soon after your death as possible which is only possible if a valid Will is in place.   • What happens if I receive notification that I have been declared a habitual traffic offender?

    An application may be made to the Court to quash the declaration. A Court may be mindful to do so if it can be shown the individual will suffer hardship and is of good fame and character. Further, if the Court is not persuaded to quash the declaration it may vary the period of disqualification to not less than 2 years.
